Welcome to Forever Industries. The terms "we", "us" and "our" refer to Werner Singer e.U., operating under the trade name "Forever Industries". We operate this online store and website, including all related content, features, products and services (the "Services").

By using or accessing our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

These Terms are governed by Austrian law, in accordance with EU consumer protection regulations. As a consumer with habitual residence in the EU, you retain all mandatory protections granted to you under the law of your country of residence.

Section 1 — Access and Account

By agreeing to these Terms, you confirm that you are at least 18 years old, or have the consent of a legal guardian. You agree to provide accurate, current, and complete information when placing an order. You are responsible for the security of any account credentials.

Section 2 — Our Products

All products offered by Forever Industries are handcrafted from natural stone. Each object is unique. Variations in color, veining, pattern, weight, and texture are inherent to the material and are not considered defects. Images on our website are representative; actual products may differ slightly in appearance.

We reserve the right to modify, discontinue, or limit the availability of any product at any time.

Section 3 — Orders

When you place an order, you are making a binding offer to purchase. We confirm acceptance of your order via email. A contract is formed when we send order confirmation.

If we cannot fulfill an order, we will notify you and refund any payment made.

Section 4 — Prices and Payment

All prices include applicable taxes unless otherwise stated. Shipping costs are shown at checkout. We accept payment methods displayed in the store. Payment is due immediately at order placement.

Section 5 — Shipping and Delivery

Delivery times are estimates only. Within Austria, deliveries typically arrive within 2–5 business days; international shipments may take 5–15 business days depending on destination.

Risk of loss passes to you upon delivery. For damages incurred during shipping, please contact us within 7 days of delivery with photo evidence.

Section 6 — Right of Withdrawal (EU Consumers)

As a consumer resident in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party indicated by you (other than the carrier), acquires physical possession of the goods.

To exercise your right of withdrawal, you must inform us at studio@forever-industries.at of your decision to withdraw by an unequivocal statement (e.g., a letter sent by post or email).

You bear the direct cost of returning the goods. Goods must be returned in unused condition, in original packaging where possible. Custom-made or personalized objects are excluded from the right of withdrawal under § 18 Abs 1 Z 3 FAGG (Austrian Distance Selling Act).

Section 7 — Warranty

Statutory warranty rights under Austrian law (Gewährleistung, §§ 922 ff ABGB) apply. Stone is a natural material; small inclusions, color variations, and minor surface differences are not defects. Defects must be reported within a reasonable time after discovery.

Section 8 — Intellectual Property

All content on the Services — including text, images, designs, logos, and product photography — is owned by Werner Singer e.U. or its licensors. You may not reproduce, modify, or commercially use any content without prior written permission. The trade name "Forever Industries" and associated branding are property of Werner Singer e.U.

Section 9 — Third-Party Services

Our store is powered by Shopify. Payment processing may be handled by third parties (e.g., Stripe, PayPal, Klarna). Use of these services is subject to their respective terms. We are not responsible for third-party services.

Section 10 — Limitation of Liability

We are liable without limitation for damages caused by intent or gross negligence, and for damages from injury to life, body, or health. For damages caused by slight negligence, our liability is limited to typical, foreseeable damages and does not extend to indirect or consequential losses. Mandatory consumer protection laws remain unaffected.

Section 11 — Online Dispute Resolution (EU)

The European Commission provides a platform for online dispute resolution (ODR), accessible at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Section 12 — Governing Law and Jurisdiction

These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in the EU, mandatory consumer protection provisions of their country of residence remain applicable. Place of jurisdiction is Vienna, Austria, to the extent permitted by law.

Section 13 — Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Section 14 — Changes

We reserve the right to update these Terms at any time. The current version applies to all new orders. Material changes will be communicated to registered customers via email.
